Waiver and Agreement

3BGolf Waiver, Terms & Conditions

Every customer, guest, or visitor to 3BGolf must read and complete this waiver before being on the Club’s property and before participating in any golf, cart, facility, event, lesson, service, program, or other activity provided or organized by 3BGolf.

  1. Understanding

    I understand that this waiver is made for the benefit of 3BGolf and its directors, officers, employees, volunteers, coaches, officials, representatives, and agents. I understand that I am considered a customer or guest of 3BGolf whether I pay to participate, visit the Club, or accompany another person, including a minor.

  2. Risks

    I understand that there are inherent risks associated with the game of golf, the use of golf equipment, golf power carts, the use of Club facilities, and participation in sports, fitness, instruction, food and beverage services, events, programs, and other activities provided or organized by 3BGolf.

  3. Potential for Injury

    I understand that these risks may include the possibility of personal injury, serious injury, illness, death, property damage, or other loss. I understand that the risks may be affected by my physical condition, health, awareness, care, and skill while participating in activities at 3BGolf.

  4. Assumption of Risk

    I freely accept and fully assume all responsibility for all risks, possibilities of personal injury, death, property damage, or other loss resulting from my participation in activities at 3BGolf. I accept these risks and agree to the terms of this waiver.

  5. Use of Golf Carts

    I acknowledge, represent, and agree that:
    1. The driver of the golf cart must be legally permitted to operate the cart and must have a valid driver’s license as required by 3BGolf. The driver shall be the sole operator of the golf cart.
    2. I am familiar with the safe use and operation of golf carts and will keep carts off greens, tees, and restricted areas unless specifically permitted by 3BGolf.
    3. I will be responsible for any damage to the golf cart and for any personal injury, property damage, or other loss arising from my use of the golf cart.
    4. I will not allow a minor or unauthorized person to operate the cart at any time.
    5. I will apply the emergency brake when the cart is parked or stationary.
    6. I will keep my feet, arms, and body inside the cart while it is moving.
    7. I will remain in full control of the cart at all times and will check the direction switch or key position before using the cart.

  6. Alcohol

    I acknowledge, represent, and agree that:
    1. I am aware that bringing alcohol not purchased from 3BGolf is forbidden.
    2. 3BGolf has the right to ask to search golf bags, bags, coolers, or other containers for outside alcohol. If I refuse, I understand I may be required to leave the property and may forfeit any green fees or cart rental fees paid.
    3. I will only consume alcohol purchased from 3BGolf.
    4. I will consume alcohol responsibly and understand that I alone am responsible for my decisions and actions related to alcohol consumption.
    5. If I consume alcohol that may affect my ability to drive, I will not drive and will arrange a safe method of transportation home.
    6. If I know another person has consumed alcohol that may affect their ability to drive, I will assist in finding them a safe method of transportation home.

  7. Waiver of Claims and Release

    In consideration of being permitted to participate in activities and to be on the property of 3BGolf, I agree on behalf of myself and my legal representatives to:
    1. Waive any claims that I have or may have in the future against 3BGolf.
    2. Release 3BGolf from liability for personal injury, death, property damage, or other loss resulting from my participation in activities, including risks caused by negligence, breach of contract, or breach of duty.
    3. Release 3BGolf from liability for injury, illness, damage, or loss related to any infectious disease, virus, bacterium, or microorganism.
    4. Hold harmless and indemnify 3BGolf from actions, claims, damages, costs, demands, and liabilities connected with my participation, my guests, minors accompanying me, or my use of the Club’s facilities.

  8. Application

    I agree that this waiver shall remain in full force and effect for all visits by me to 3BGolf, whenever they occur, and that entry onto the property is conditional upon agreeing to the terms of this waiver.

  9. Governing Law

    I agree that this waiver and all terms contained within it are governed by the laws of the Province of Ontario. Any legal proceeding relating to this waiver shall be handled in the Province of Ontario.

  10. Confirmation

    I confirm that I have had sufficient time to read and understand this waiver in its entirety. I agree to the terms freely and voluntarily. I understand that this waiver is binding on myself and my legal representatives.
